Cayman Islands Court Of Appeal Says Investor's Winding Up Petition is an Abuse

The Cayman Islands Companies Law gives the Court the power to order that a company be wound up and independent liquidators appointed if the Court is of the opinion that it is "just and equitable" to do so. On 18 March 2010, in Camulos Partners Offshore Limited v Kathrein & Co, the Court of Appeal confirmed the limitations on that jurisdiction and struck out winding up proceedings filed by a disgruntled investor designed to apply pressure on a solvent fund to accept the investor's demands.
