In the construction sector, we have acted for a number of public authorities in respect of litigation arising from public projects. We are also experienced in advising in respect of public procurement issues, both in the public and private sector.
Our finance and banking team work closely with our litigation and dispute resolution team, ensuring that our clients benefit form strategic litigation and disputes advice, founded on extensive experience/expertise of banking practice. In particular we have acted for public authorities with respect to construction litigation and the National Asset Management Agency with regard to a number of enforcement matters.
Recent examples of cases include:
- Acting for Galway City Council in its successful Supreme Court Appeal in the case of Samuel Kingston Construction Limited -v- Galway City Council. This involved a challenge to an arbitration award which had been upheld in the High Court. The Supreme Court set aside the award and removed the arbitrator for misconduct.
- Acting in respect of a challenge brought against a public sector client due to the alleged failure by the client to enforce its own tendering rules and, in particular its rules regarding abnormally low tenders.
- Acting for a public sector client in respect of its rights following the determination of a construction contract by the contractor. The issue related to the obligation of the public sector client to carry out a retender of the project and was successfully resolved in favour of our public sector client.
- Acting for a public sector client in respect of prosecutions brought for breach of environmental law relating to the contamination of public waterways.
