We act hand in hand with our colleagues in the Trusts Group for trustees, beneficiaries, protectors and other office holders within trust structures in respect of a wide variety of disputes concerning family trusts, unit trusts and charities.
We regularly appear before the Cayman Islands and British Virgin Islands Courts on behalf of major institutional trustees on complex trustee direction applications and have assisted and advised protectors and beneficiaries involved in (or who are contemplating bringing) proceedings before these Courts. We have also acted in proceedings to restructure trusts and charities.
Examples of our recent cases include:
- Acting for Merrill Lynch Bank & Trust Company (Cayman) Ltd as in relation to the disputes between Yahya Demirel and the Turkish entity responsible for assuming the assets and liabilities of failed banks. The Cayman Islands proceedings have raised novel issues relating to trusts, enforcement of judgments, and cross-border bankruptcies, one of which was recently heard by the Privy Council.
- Acting for a major institutional trustee in relation to ongoing disputes between various branches of the settlor's family.
- Representing a beneficiary of a Cayman Islands STAR trust concerning related family litigation in Hong Kong.
