
Financial Services Regulation
The regulatory financial services function consolidates the firm's knowledge and resources on a wide range of regulatory matters and often handles sensitive matters for our clients.
In the Cayman Islands, members of the group participate in industry and governmental policy development committees, such as the Private Sector Consultative Committee, Financial Services Council, Financial Services Legislative Committee, (AML) Guidance Notes Committee and other regulatory and policy working groups on specific topics, which allows the group to provide the latest advice and foresight on topical matters.
The regulatory financial services function provides assistance to licensees by liaising with the financial services regulators in the Cayman Islands, Ireland and the British Virgin Islands. We regularly advise our banking, finance and securities investment clients on matters relating to conduct of business, licensing and regulatory reporting and approvals in relation to restructurings, recapitalisations, mergers and acquisitions. We also assist in relation to internal controls and risk management issues. Our Irish office has developed particular expertise advising on governmental and statutory debt initiatives.
In this regard, the group is adept at advising on record retention and disclosure obligations (including dealings with the various regulatory, law enforcement and governmental agencies requesting information), as well as anti-money laundering, anti-corruption and sanctions advice.
